Terms of Service
These are the terms of using 161. We have kept them in plain English, because you should not need a lawyer to understand what you are agreeing to. You accept these terms when you tick the box at checkout on get161.com or tap Agree and continue in the app, and we record the version you accepted and the time.
What 161 is
161 is a fitness and nutrition planning app that adjusts as your weeks change. It builds a training and nutrition plan around your numbers, your equipment, and your real life, and includes a built-in coach for everyday questions. It is available as a web app and a native mobile app.
You must be 18 or older to use 161.
What 161 is not
161 gives general fitness and nutrition information only. It is not medical advice, not a prescription, not a diagnosis, and not treatment. Using 161 does not create a doctor-patient or dietitian-client relationship between you and us.
The calorie and training numbers in your plan are estimates worked out from what you enter. They are not an individual prescription.
The built-in coach gives pre-written answers picked by rules on your device. It is not a person and not an AI model, and it is not a doctor, dietitian, or therapist. When a question is clinical, it is designed to say so and point you to a professional rather than guess.
161 is not a treatment for eating disorders. The app has a few quiet options you can turn on: you can hide the numbers, weigh in without seeing the number, and switch off calorie-cutting suggestions, and the coach points you to professional resources when you describe a crisis. Those are settings, not care. If you have, or think you may have, an eating disorder, please work with a qualified professional.
If you are struggling right now

These services are free, confidential, and there for exactly this. Please use them.
Talk to your doctor first
Talk to your doctor before you start or change an exercise routine or how you eat, especially if you have a medical condition, take medication, are pregnant, or have a history of an eating disorder. If something feels wrong while you are training or changing how you eat, stop and get medical help.
Your choice and your risk
Exercise and changing how you eat carry a risk of injury or illness. You take part by your own choice and you accept that risk. Before your first plan the app asks a few readiness questions, and you agree to answer them truthfully.
Pricing and renewal
On our website the membership is $14.99 a month or $99.99 a year, billed to the card you provide. There is no free trial without a code. With a valid invite code from a 161 member, or a valid code entered on one of our sign-up pages, the first 14 days of either plan are free: we take your card at checkout and charge the plan's price when the 14 days end, unless you cancel before then, and then every month or every year until you cancel. There is one free trial per person. If you have had a free trial or a membership before, the plan starts without one, and if we only find that out after checkout, we cancel that signup before anything is charged and email you. Without a code, each plan is charged at checkout, and then every month or every year until you cancel. In the iPhone app the price is what the App Store shows before you confirm, and the membership renews at the end of each month or year until you cancel. Cancelling takes two taps in the app or one email to us, takes effect at the end of the period you have already paid for, and there is no retention maze. We tell you the price and the renewal terms before you are charged anything, and we will tell you before any price change applies to you.
Membership bought through Apple is billed and refunded by Apple under its terms; membership bought on our website is billed by us through Stripe and covered by these terms. 161 is an iPhone app, so check that you have an iPhone before you buy.
Our guarantee. Log something in 161 on 15 different days within the first 30 days from the day you join: a meal ticked, a journal or check-in entry, a habit, a workout, a walk or cardio. A planned rest day or an away day with nothing logged does not count. If 161 is not for you after that, request a refund by day 35 from the day you join, in the app or by emailing [email protected], and we refund everything you have paid us on our website since you joined, in full. The refund ends your membership at once. The guarantee is once per member. If your membership is billed by Apple, Apple gives the refund: ask at reportaproblem.apple.com.
Apart from the guarantee, payments made on our website are not refunded, including for a period you have started and not used, except where the law requires it or where these terms say otherwise.
Early access
161 is still being built: we may change, add, or discontinue features. If we ever discontinue 161 entirely, we will give you reasonable notice and refund any prepaid period you have not received.
Your account
You are responsible for your account and for keeping access to it secure. Give us accurate information when you sign up, and let us know if you believe someone else has accessed your account. Most of your health data lives only on your device, see the Privacy Policy, so keeping your device secure matters too.
Acceptable use
161 has no feeds, profiles, or community spaces, and nothing you enter is posted anywhere. When using 161, you agree not to:
- Attempt to break, probe, or overload the service, or access other people's data
- Use 161 for anything unlawful, or impersonate another person
- Copy, resell, or redistribute the app's software or programming content
We may suspend accounts that break these rules. Where practical we will warn you first.
Ending things
You can stop using 161 and delete your account at any time, from within the app or by emailing us. We may suspend or terminate accounts that violate these terms. If we terminate your account without cause during a paid period, we will refund the unused portion.
Our content, your content
161, its software, design, and programming content, belongs to us and our licensors. There is nothing to post in 161, so we host no content of yours: your plan, your logs, and your journal stay on your device and stay yours. If you join buddies, the only thing shared is the tick for a habit you approve. See the Privacy Policy.
Disclaimers and limits
161 is provided "as is." We work hard to make it reliable and useful, but we cannot promise it will always be available, error-free, or right for your specific situation, and we make no warranties beyond those the law requires. Plans and coaching are general guidance built from the information you provide, results vary, and no outcome is guaranteed.
To the fullest extent permitted by law, our total liability to you for any claim arising out of your use of 161 is limited to the amount you paid us in the twelve months before the claim (or $50 if you have paid nothing), and we are not liable for indirect, incidental, or consequential damages. To the extent the law allows, these limits also apply to claims about injury or health outcomes from following the general information in 161. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.
Governing law
These terms are governed by the laws of the United States. If a dispute comes up, talk to us first, most things can be sorted out with an email.
Changes to these terms
If we change these terms in a way that matters, we will update the version and date above and tell you in the app before the changes take effect. When the version changes, the app asks you to accept the new terms before you carry on.
